MssyNotes Terms of Use

These terms are an agreement between you and Micreations Ltd, a company registered in England and Wales (company no. 16797696), registered office 3rd Floor, 86-90 Paul Street, London EC2A 4NE, United Kingdom ("we", "us"). They cover the MssyNotes app on iPhone and iPad, the desktop web app at app.mssynotes.com and this website. By using MssyNotes you agree to them. Our Privacy Policy explains how we handle your data.

1. Your account

• You need to be 13 or older to use MssyNotes. If you're under 18, a parent or guardian should agree to these terms with you.
• You sign in with a one-time code sent to your email. Keep access to that inbox safe: anyone who can read it can sign in as you.
• You're responsible for what happens in your account. Tell us straight away if you think someone else has got into it.

2. Your content

• Your boards are yours. You keep all rights to the notes, drawings, photos, files and voice-note text you add.
• You give us permission to store, copy, sync and display your content only so we can run MssyNotes for you: keeping it on your devices, backing it up, and showing it to the people you choose to share it with. We don't use it for advertising and we don't sell it.
• Only add content you have the right to use.

3. Sharing and teams

• When you share a board, the people you invite can see everything on it, and editors can change or remove things. Only share with people you trust.
• On a team board, the team owner and admins control who has access. If you leave a team, boards in that team stay with the team.
• Things you add to someone else's board stay on that board if you leave it or delete your account.

4. Things you must not do

Don't use MssyNotes to:

• break the law, or store or share anything illegal, including child sexual abuse material;
• harass, threaten or abuse anyone, or share someone's private information without their permission;
• share malware, phishing or spam;
• infringe anyone's copyright, trade marks or other rights;
• try to get into other people's accounts or boards, overload or attack the service, or get around plan limits or security controls;
• copy, resell or reverse-engineer the service, except where the law allows.

We may remove content or suspend accounts that break these rules. Where we can, we'll tell you first and give you a chance to fix things.

5. Plans and payments

• Free is free. Pro, Team and Enterprise are paid plans. Prices are shown in the app and on our website, in pounds and including VAT where it applies.
• Paid plans renew automatically each month or year until you cancel. You can cancel at any time. Your plan keeps working until the end of the period you've paid for, then returns to Free.
• On iPhone and iPad, you pay through the App Store. Apple handles payment, renewals, cancellation and refunds under its own terms. Cancel in Settings › Apple ID › Subscriptions at least 24 hours before renewal. Apple's Standard Licensed Application End User License Agreement also applies to the iOS app.
• On the web, you pay through Stripe. You can manage or cancel from Settings › Manage plan.
• 14-day cancellation (web): if you live in the UK and buy a plan on the web, you can cancel within 14 days of your first payment for a full refund. Just email us. Refunds for App Store purchases are handled by Apple.
• Team plans are paid by the team owner, per editor. View-only members are free. Seat changes are charged or credited for the rest of the billing period.
• Enterprise plans are agreed in writing, and that agreement takes priority over these terms where they differ.
• If we change a price, we'll tell you at least 30 days before your next renewal. You can cancel before the new price applies.

6. Storage limits

Each plan comes with a storage allowance (shown in Settings). If you go over it, for example after moving from Pro to Free, nothing is deleted. You won't be able to add new files until you're back under the limit or upgrade.

7. Ending your account

• You can deactivate your account, or delete it and all your data, at any time from Settings. Deleting cancels web subscriptions. Cancel App Store subscriptions with Apple.
• We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires us to.
• If we ever decide to close MssyNotes, we'll give you at least 30 days' notice and refund any time you've paid for but won't get to use.

8. The service

We work hard to keep MssyNotes running, secure and backed up, but we can't promise it will always be available or free of bugs. Features may change as the app develops. If we remove something important from a paid plan, we'll tell you and you can cancel. Keep your own copy of anything you can't afford to lose.

9. Our responsibility to you

• If you're a consumer, you have legal rights in relation to services that aren't provided with reasonable care and skill, or as described. Nothing in these terms affects those rights.
• We don't exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to exclude.
• We're not responsible for losses that weren't foreseeable, or for content other people add to boards you share.
• If you use MssyNotes for business, we aren't liable for loss of profit, business or data. Our total liability to a business user is limited to the amount it paid us in the 12 months before the claim.

10. Changes to these terms

We may update these terms. If a change matters, we'll tell you in the app or by email before it takes effect. If you don't agree, you can stop using MssyNotes and delete your account.

11. Law and disputes

These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. Please contact us first, as we'd much rather sort things out directly.
